Terms and Conditions

Terms and Conditions Definitions 
Owner: Bouncing Castles 
Hirer: The person hiring/renting the equipment from the owner.
Equipment: The Soft Play and accessories hired out by the owner to the hirer.
Contract: The agreement between the owner and the hirer for the supply of equipment at a negotiated price, within a defined hired period as bound by the terms and conditions. The hirer acknowledges the agreement becomes binding upon issuing an order either verbal or written requesting the owner to provide equipment and/or services to the hirer. 
Payment: The hirer agrees to pay the owner's hire charge and any other charge, including charges for damage and repairs, loss that may be incurred and paid by the owner. These charges will be paid in full by the hirer to the owner prior to the owner releasing the equipment to the hirer. Subsequent charges arising from loss, damage, repairs, and other expenses are to be paid immediately upon receipt of a tax invoice. 
Cancellation Fee: 50% if cancelled within the week prior to the function date unless due to wet weather.
Hirer's Obligations: The hirer will be responsible for the equipment hired from the time of its delivery until collection by or return to the owner. The hirer upon installation, delivery, or collection of the equipment immediately examines the equipment to satisfy itself to its condition and suitability for the purpose for which it requires the equipment. The Hirer will assume the risk and indemnify and hold the owner harmless from against any and all property damage and personal injury resulting from the use of the equipment. The Hirer will be responsible for all surface preparations and repairs. The Hirer will use the equipment in a proper, safe manner and only for the purpose and capacity for which it was designed.

1. DELIVERY:  The hirer to provide clear access to the area where the equipment is going to be set up before and after your event. The hirer to secure all dogs before setup. The hirer to sweep and clear hard surface that Soft play will be setup on of anything that may cause damage to the gear e.g. Gravel, Sticks & Rubbish.

2. SAFETY RULES: The Hirer will provide a person over 18 years who shall supervise the use of equipment at all times in particular, the Hirer shall ensure:
A.  Ages 0-4 years only to be climbing on the equipment and especially in the ball pit
B.  Shoes Off at all times while in the Soft play area  (adults too especially no heels!)
C.  No Food or Drink 
D.  No Face Paint, Glitters, confetti
E.  No Sharp Objects
F.   No water play or sand
G.  Keep Soft Play and balls inside the play area
H.  No Adults or older children are to sit on the sides of the ball pit please

2. CLEANING:  The hirer will take responsible steps to ensure the soft play equipment remain in a clean condition.  If something is accidentally spilt on the Soft play please wash off immediately with a damp cloth. The hirer will pay a cleaning fee of $50 if equipment is picked up in a dirty condition.

3. LOSS OR DAMAGE OF EQUIPMENT: The Hirer will be responsible for lost or stolen equipment for any reason whatsoever. It is agreed that upon the completion of the period of the hire the whole of the replacement cost of the missing equipment will be charged to the hirer. If the Equipment is damaged in anyway during the Hire of the Equipment the Hirer shall be charged a fee to cover the repair or replacement of the damaged hire equipment parts or whole equipment. All broken and damaged equipment must be returned to the owner otherwise they are classified as missing items. (Exceptions are from time to time a couple of ball pit balls may be squashed/damaged but if excessive amounts <10 are damaged then no exceptions will be made) 

4. COLLECTION: Bouncing Castles is hereby authorized to enter any premises upon which the equipment may be located or thought to be located for the purpose of collecting the same at the conclusion of hiring.  All Soft Play equipment must be in the same condition as when they arrived. We reserve the right to take a photo of the Soft Play equipment on your property. This is for proof reasons if the Soft Play is picked up in unacceptable condition. If Equipment is setup outdoors and In the Event of Rain, we reserve the right to come out and pick up early if the equipment cannot be put under shelter for the remainder of the Hire.

5. DISCLAIMER: Bouncing Castles has explained the Policy requirement regarding supervision of equipment to the person named below. The person/s or organization hiring this Soft Play equipment will be responsible/legally liable for any damage to property or injury to any person occurring from or as a result of misuse or reckless use directly or indirectly related to the activity. These guidelines are for the safety of all people using this equipment, and it is the sole responsibility of the hirer to ensure they are fully adhered to at all times.  Our Company Bouncing Castles cannot accept any responsibility or action taken for any injury caused to anyone using this equipment.

I have read the above agreement and fully understand and accept the terms & conditions above.

I am aware that whilst in my care I am fully responsible for the Soft Play equipment and accessories and will pay for any loss or damage that may occur, this will include the equipment being returned in an unacceptable condition, i.e. if it is in a sticky food/drink soiled condition, I will be expected to pay an additional cleaning charge.
